These Terms of Service ("Terms") govern your use of the Elynd mobile application ("the App") operated by Comads OÜ (registry code 17276947), located at Ahtri St. 12, 15551 Tallinn, Estonia.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 16 years of age and agree to comply with and be bound by these Terms.

2. Description of Service

Elynd is an AI-powered meditation and healing application that provides guided meditation sessions, mindfulness exercises, and personal wellness tracking. The App may include both free and premium features.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to any part of the App
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble any part of the App
• Copy, modify, distribute, or create derivative works
• Use automated systems to extract data from the App

5. Intellectual Property

The App, including all content, features, and functionality, is owned by Comads OÜ and protected by international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

6. Subscriptions and Payments

• Payment will be charged to your Apple App Store or Google Play Store account upon confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• You can manage and cancel your subscription through your device's app store settings
• Refunds are handled according to the policies of the respective app store
• If you withdraw your consent to the processing of wellness data (as described in our Privacy Policy), core App features such as personalised meditations and progress tracking will no longer be available to you. In such cases, refunds for any remaining subscription period are subject to the refund policies of the respective app store

7. AI-Generated Content

The App uses artificial intelligence technology (including services provided by third parties such as Google, OpenAI, and speech-synthesis providers) to generate personalised meditation content, scripts, audio, recommendations, and conversational responses. You acknowledge and agree that:

• AI-generated content is produced algorithmically and may not always be accurate or suitable for your specific needs
• AI-generated content is provided for general wellness and relaxation purposes only and does not constitute medical or therapeutic advice
• You should not rely solely on AI-generated content for any health-related decisions
• We do not guarantee the accuracy, reliability, or appropriateness of any AI-generated content
• We may change, update, or replace the AI models, text-to-speech engines, and voices used to generate meditation audio at our discretion, as part of ongoing product improvements. Voices offered by name (such as "Luna" or "Gareth") may be powered by different underlying speech-generation technology over time
• Changes to AI models, speech engines, or voices are a normal part of service evolution and do not, on their own, constitute a material change to your subscription

If we make a change that would substantially reduce the core functionality you subscribed to, we will give you reasonable advance notice through the App or by email, and you may cancel your subscription. Any refund for unused portions of your subscription will be processed according to the policies of the Apple App Store or Google Play Store, and applicable mandatory consumer protection laws.

8. Health Disclaimer

The App provides meditation and wellness content for general informational and relaxation purposes only. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical or mental health condition.

If you are experiencing a medical or mental health emergency, please contact emergency services immediately.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Comads OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time for any reason, including if we believe you have violated these Terms. You may also delete your account at any time.

12. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the App. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Tallinn, Estonia, unless mandatory consumer protection laws in your country of residence provide otherwise.
